Risk passes to you upon delivery to your warehouse or to an agreed delivery point. • Hobart Motorcycles shall not be responsible for non-delivery or delay in delivery of any goods caused by force majeure and you and Hobart Motorcycles shall be excused from performance of their respective obligations when and to the extent such performance is delayed or prevented by force majeure. If your need for the goods is reduced or suspended as a result of force majeure, and notification is within reasonable time of acceptance of the Order and prior to transfer of ownership, you shall be entitled to terminate the agreement. For the purpose of this commitment force majeure shall include but is not limited to natural disasters, civil disasters, political event, change of legal / political environment, business disruption, accidents, earthquake, flood, hurricane or typhoon, tornado, tsunami, volcanic eruption, wildfire/bushfire, landslide or avalanche, fire, flood, storm, earthquake, terrorist acts, revolt, war, financial markets disturbances, changes of regime or tax or regulatory authority, energy failure, external telecommunications failure, and/or failure of transport systems. • You assume all risks and liabilities for consequences arising from the use of the goods whether singly or in combination with other goods and indemnify Hobart Motorcycles in respect of any such use. Hobart Motorcycles is not liable for any infringement of patent rights arising out of the use of such goods by you or your instructions, expressed or implied, and it is your responsibility of to ensure that the goods when used by you are not damaged and no liability will be accepted by Hobart Motorcycles for the consequences of the use of damaged goods by you. • Nothing in these Conditions of Sale is intended to exclude, restrict or modify any statutory obligation of Hobart Motorcycles implied by the Goods Act, 1958.

Shipping and Handling

Shipping

We ship orders Australia wide using Australia’s fastest and most trusted express delivery networks. All orders that weigh less than 3kg will automatically be sent Express Post . Any orders 3kg or over will be shipped with Australia post or a Courrier. To find the weight of your order, simply add each item’s weight together. You’ll find the weights specified in the product listing. If your order was shipped via Express Post, it will generally be delivered within 1-2 business days. This is provided you are within the Express Post serviced area.

Handling

Hobart Motorcycles ship your order within 48 hours from order completion. With the exception on Weekends or public holidays, where orders will be sent the following business day. Hobart Motorcycles will contact you if for any reason a product is not in stock and organise a suitable alternative or express postage of your order.

Refunds and Returns

Returns

Hobart Motorcycles allows you 7 days to return a product that you are not satisfied with. Your right of return starts from the moment your order is delivered. You can return the product to us within this time frame, at your own expense, with your invoice. We request that you send us the merchandise by registered post and that you purchase insurance with your carrier for the value of the merchandise. This is necessary should they lose or damage the goods. Shipping fees remain the customer’s responsibility. The present right of return only applies to products that are returned in their original, complete working condition (packaging, accessories, user guide etc.). Any product that has been damaged, is not in its original packaging, or has packaging that has been worn beyond simply opening the product, will not be refunded.

Refunds

Hobart Motorcycles will accept returns if a product is faulty or is significantly different to what is described in the item description. Consideration for returned items will be given as a full refund of the purchase price (minus freight) or as a credit, at the discretion of Hobart Motorcycles . Postage and handling costs will not be refunded. If an item is to be returned it must be returned in its original, sealed package and must be unused. If you change your mind about an ordered product then we will expect you to cover the shipping costs in returning the items to us. Any opened goods will not be refunded, unless there is a problem with product quality. In these circumstances when we can identify a problem we will give a full refund and pay shipping costs.
